Terms and Conditions of Sale
All orders are F.O.B. Norco California. The cost of crating and or freight are never included in quoted prices unless specifically requested and noted on quote by FCM.
Prices
All FCM prices are net. All prices are subject to change without notice.
Minimum Order
There is never a minimum order at Fantasy Creations in Metal.
We value your business and we are happy to be working with you!
Terms
Orders are shipped prepaid via check, C.O.D. or credit card purchase, unless credit has been established. Once open account has been approved, our terms are a firm net 30 Days from the date of shipment and invoicing.
Past Due Accounts
On any unpaid balance still open past the 30-day period of shipping/invoicing.
FCM may add a late payment charge at the rate of 1.5% per month (18%APR). All expenses incurred in collecting any unpaid balance will be added to the debt as legal fees.
Pro-Forma invoices and orders requiring deposit cannot go into production without deposit being received.
We gladly accept VISA, MasterCard, Discover and American Express.
We add 3% to credit card purchases to cover a portion of the credit card charge levied by the credit card companies.
Resale Card
The state of Californa requires us to have a current resale card on file for everyone that is resale. Any sale made in California must have a resale card or we have to charge tax on that sale.
Incoming Orders
We gladly accept your orders via phone, email, or fax.
Your Custom Designs
At FCM we take all foreseeable precautions when recreating your designs to your specifications, however we are not engineers and we strongly recommend that you have your designs reviewed by an architectural engineer for assurance of structural soundness for your specific application. FCM will not be held liable for any structural defects due to unknown flaws in customer designs and specifications.
Custom orders need to be in writing with drawings and details clearly stated.
If you do not have drawings and FCM is being asked to configure assembly method, we will send you our concept. It is our client’s responsibility to turn our concept into a formal and workable drawing. If FCM is being asked to create your drawing, we will have a minimum charge of $250.00. Depending on the complexity of the drawing the price may go much higher. We must have drawings, to fabricate exactly what you are expecting.
Acknowledgements
We acknowledge all orders within 24 hours. At that time, we do our best to fill in any additional details, from pricing to approximate completion schedule.
If you do not hear from us, please call us. We have learned that orders sent through cyber space don’t always land safely at the other end.
Custom Orders
All custom orders must be accompanied by a 50% deposit and detailed drawings with all necessary specifications clearly noted. Custom orders cannot go into production until all details have been addressed and signed off by customer. Once material has been purchased and production has begun, custom orders cannot be canceled without incurring additional charges. Custom work cannot be returned.
Plated Finishes
We plate in a large variety of finishes and colors. Antique and chemical finishes are all done by hand and may vary slightly in color and texture from job to job. Due to the nature of plating this cannot be helped.
Special Quotes
Special quotes are valid for 30 days, unless otherwise specified. This includes large quantity quotes and special item/custom quotes.
Standard Product Line Lead-times
At FCM we carry a large inventory of standard product line items for your immediate shipment.
Due to our many and varied designs and finishes, please refer to specific items for product
lead times.
On The Shelf, Standard Product Line
Most of our decorative hardware line is in stock for same day shipment. This includes: Drawer Pulls. Grommets and Sleeves. Standoffs and Caps. Trash Rings. Ecology Medallions. Tube Legs and some Pedestal Bases designs as well.
Blanket Orders
FCM has a Blanket Order Program: We produce and stock large quantity orders specifically for you, that you can take in weekly or monthly releases over a period of one year or less. If product is not used within one year, balance will be sent for final billing.
Returns
Our standard product line items can be returned only if no modifications were made by our customer or by FCM at our customers’ request. Returns must have prior authorization. Product must be received in resalable condition. Customer is responsible for seeing that product being returned is properly packaged to protect from shipping damage. Concealed damage claims must be filed with carrier by customer. If returned product is damaged: at customer’s choice, FCM will bill client for the cost of the product repair or return the product to customer. Custom work cannot be returned to FCM. All shipping fees are paid by customer.
WE DO NOT HAVE A RESTOCKING FEE ON OUR ON-THE-SHELF HARDWARE ITEMS
We do not have a restocking fee on hardware, but it must be returned in original packing and damage free. All items must be well packed for return shipment. We cannot accept parts that have been damaged.
Tube Legs & Certain bases (without modifications) may be returned with a 20% restocking fee.
This fee covers the cost of un-assembling the product, inspecting each component piece for damage, repacking and re-shelving the individual components. If there are any damaged components, FCM will repair and charge this cost back to your account.
Delivery Dates
FCM is not bound too, or responsible for any late fees or penalties for delayed shipments. We are your eyes… and we take our responsibility to give you the finest product very seriously. It is our goal to ship your orders on time and even ahead of schedule at every opportunity. However due to the myriad of processes involved in making your product beautiful, there are times when we must reject items in powder coating, plating, or other processes, causing our Q.C. department to send your item back through the system. Any of the above can cause a delay in shipping your order. We will always keep you informed of date changes when they occur.
Delivery Fee
We will deliver your standard sized products to you within a 60-mile radius for $50.00. Over 60 miles and up to 75 miles, we will deliver for $75.00, per full truck load. If your order requires more than one trip, each trip is charged an additional delivery fee. Oversized product will be delivered via oversized truck and charged additional fees.
Freight Carriers
FCM will always ship your product as economically as possible. We will gladly use the carrier of your choice. Freight fees will be added to your invoice.
Damaged Shipment
Upon release of product by Fantasy Creations in Metal to the transportation company, shipment becomes the property of the consignee. The consignee assumes all risks of loss and damage to the product while in transit. It is the customer’s responsibility to file any damage claim within 5 days after receiving damaged goods.
Cartoning charge
For tube legs being shipped via UPS, Fed-Ex, or Common Carrier there is a small charge to pack your product for shipment. This fee is to cover the additional material and labor required to pack your legs properly to insure they arrive to you as beautifully as they were when they left us.
The fee is $5.00 for standard size boxes.
**2” Round or Square=4 per box. **3” Round or Square=2 per box.
**4” Round or Square=2 per box. **6” Round or Square=1 per box.
**Racetrack Oval=2 per box. **Tear Drop=2 per box.
**If oversize cartoning is required, the charge will be $8.00 per box.
Pallet and Packing
For orders being shipped via truck line there is a $25.00 minimum pallet and packing fee added for the first item, if there are additional items, this packing fee will increase incrementally to insure your parts get to you in the same beautiful condition they were in when they left our facility. Fees are computed based on the amount of protection we need to add including wood, protective packing and wrapping used to insure your valuable products make it to you safely.
Crating Fees
Some items need to be crated for shipping for added protection and there is an additional charge for this based on the size of the crate. We will add this this cost on your final invoice.
UPS
FCM ships all shippable product via UPS and adds 20% for packing and handling.
UPS Claims
UPS must be notified at once of damage or shortage, for UPS to inspect before returning product to FCM. For your own protection, we strongly urge every customer to inspect package for damage within 24 hours of receipt.
FCM Claims
Please notify us within 3 days of any discrepancy in shipment or invoicing. We need to know this quickly so we can find out what happened and correct it right away. Your satisfaction is our is number one goal!
Warranty
FCM product is warranted to the original purchaser for a period of 12 months, (under normal use and maintenance) from the date of shipment, to be free from defects in materials and workmanship. Unless otherwise specified our products are meant for inside use. This warranty is void if the product has been damaged, misused, altered, or repaired by anyone other than Fantasy creations in Metal Inc.
